(1) Any violation of the provisions of this regulation or failure to comply with any of its requirements, including violation of conditions and safeguards established in connection with grant of variances or site development plans, shall constitute a misdemeanor.

(2) Any person who violates this regulation or fails to comply with any of its requirements shall, upon conviction thereof, be fined not less than 10 nor more than $100 for each day that such violation continues; but, if the offense is willful, the person convicted thereof shall be fined not less than $100 nor more than $250 for each day that such violation continues, or imprisoned not more than 10 days for each day such violation continues or both, and in addition shall pay all costs and reasonable legal fees involved in the case.

(3) Nothing herein contained shall prevent the Town of Canton from taking such lawful action as is necessary to prevent or remedy any violation.
